Evidence of Language Ability for Subclass 485 Visas

From 27 October 2008, the Migration Regulations 1994 (‘the Regulations’) are amended to make it mandatory for subclass 485 visa applicants to provide evidence of English language ability at the time of application.
Affected legislation
The following provisions of the Regulations are amended:
Schedule 2 – Paragraph 485.215(b)
Schedule 2 – Paragraph 485.215(c)
Schedule 2 – Clause 485.222
Additional information:
Prior to these amendments it was permissible for applicants for a subclass 485 visa to provide evidence that they had made arrangements to undergo a language test for proficiency in English. These amendments make it mandatory for an applicant to provide evidence that an approved test has been undertaken and that they have the required proficiency in English at time of application.
Transitional provisions: These amendments apply to applications for visas made on or after 27 October 2008.
Forms: Updated Form 1276 will be available from January 2009.
Instructions: PAM3 will be amended to reflect these changes by 27 October 2008.
