457 VISA and pregnancy

  • Hi everybody,

    I have a tricky question and hope someone can help me.

    I'm currently on a 457 VISA, however I found my future husband in Australia. I live in Sydney he in Brisbane and we haven't been together for 12 months so I can't apply for the spouse VISA.

    Should probably as well mention he is Australian.

    Does anybody know what would happen if I would fall pregnant - VISA wise...?

  • well you might have a baby about nine month later, if it is confirmd that an Australian citicen is the father of the Child the child will be australian Citicen.

    this way you would have the chance to stay with your baby in australia.

    also if the father likes you to have his baby he might marry you and this way you would not have to have been with him for 6 month.

    the people at immigration know more then I do.

    so if you like this man an he loves you there is no need to fall pregnant you could stay if he marrys you

  • Eigentlich nix weiter, also das besorgt dir nicht automtisch ein Visum.

    Allerdings wird das Baby dann Australier sein.

    Durch das ganze Spouse theater musst du trotzdem noch und ich glaube du kannst das Kind nicht so ohne weiteres mitnehmen, das es halt aussie ist :)

    the 12 month relationship requirement can be waived if there is a common child:

    -> The 12-month relationship requirement may be waived if one of the following situations applies:
    * you can demonstrate compelling and compassionate circumstances, such as if you have children with your partner.

    So, the child is born, parents organise the birth certificate asap and apply for a subclass 820 spouse visa. If Mum stops working and the subclass 457 visa therefore ends, a bridging visa kicks in until the 820 visa application is decided.

    One of my students had a similar scenario, just that she was on a student visa :D
