Hi,

For subclass 457 visa applications lodged on or after 1 July 2007 the English proficiency requirement is as follows:
1. Where the main applicant is required to be licensed/registered for the nominated position and that license/registration requires a level of English language proficiency greater than equivalent to an average band score of 4.5 in an IELTS (International English Language Testing System) test (e.g. IELTS 4.5 in all 4 components or IELTS 5, etc), the applicant must have (and may be requested to demonstrate through a formal test) that level of English language proficiency. In all other cases, the main applicant must have (and may be requested to demonstrate through a formal test) English language skills equivalent to at least an average band score of 4.5 in an IELTS test unless:
2. they are an 'exempted person' or
3. the applicant's base salary is equal to or greater than $75,000 and grant of a visa is 'in the interests of Australia'.
A visa applicant is considered to be an 'exempted person' if, the person:
1. whose first language is English and is the holder of a passport from Canada, New Zealand, the Republic of Ireland, the United Kingdom, or the United States of America, and the occupation does not require English for registration or licensing
2. who is nominated for a gazetted occupation in ASCO (Australian Standard Classification of Occupations) major groups 1-3 (managers, administrators, professionals and associate professionals) and the job does not require English for registration or licensing; or
3. who is nominated for a gazetted occupation (ASCO 4-7) and is a person who completed at least five consecutive years of full-time study in a secondary and/or tertiary education institution where at least 80 per cent of the instruction was delivered in English and the job does not require English for registration or licensing.
